How the SmartPark 360 appeal process works

    Appeal to SmartPark 360 first

    You must give them the chance to cancel before anyone else will look at it. Do this within 28 days, in writing, with your evidence attached.

    They accept or reject

    If they reject, they must issue a verification code for POPLA. If they refuse to give you one, that is itself worth raising with the BPA.

    Escalate to POPLA

    Free for motorists. The adjudicator is independent and the decision binds SmartPark 360, though not you.

Grounds that work against SmartPark 360

The signs were inadequate

A charge on private land depends on a contract formed by adequate notice of the terms. If the signs were too high, too small, obscured by foliage or unlit at night, no contract was formed and no charge arises.

Notice to Keeper timing

Schedule 4 of the Protection of Freedoms Act 2012 sets strict deadlines. Where no ticket was put on the windscreen, the Notice to Keeper must arrive within 14 days. Miss that and keeper liability fails entirely.

Two visits read as one stay

Entry and exit cameras with no mid-site detection routinely merge two separate visits into one long one. Ask for every timestamped image from that day, not a selected pair.

A few minutes over

The Code of Practice requires a grace period at the end of a parking period, plus reasonable time on arrival to read the signs and decide whether to accept the terms.

No landowner authority

SmartPark 360 must be able to produce unredacted written authority from the landowner covering the date and the specific charges. A contract with a managing agent is not enough.
